Kindpair Terms of Service

Effective date: February 17, 2025

These terms govern your access to and use of Kindpair, KindPair's web-based AI companion service.

Acceptance and Updates

By using Kindpair you agree to these terms and referenced policies.

If you use the service for an organization, you confirm authority to bind that organization.
Terms may change as the product or legal requirements change.
Updated effective dates are posted with material-change notices when appropriate.

Eligibility and Accounts

Kindpair is intended for users 18 and older.

Provide accurate account information and keep credentials secure.
You are responsible for account activity and compliance with these terms.
Account sharing or bypassing controls and restrictions is prohibited.

Acceptable Use

Use Kindpair lawfully and respectfully.

No unlawful, harmful, harassing, hateful, or rights-infringing content.
Uploads may be screened automatically; blocked NSFW attempts may be logged for moderation.
No attempts to interfere with service operation, security, or provider systems.

Content and License

You retain ownership of your inputs and grant rights needed to run the service.

You grant KindPair a worldwide, royalty-free license to host, store, and process submitted content to provide and improve Kindpair.
Telemetry and de-identified aggregates may be used to improve reliability and safety.
Kindpair software, avatars, and brand assets are owned by KindPair or its licensors.

AI Output Disclosures

Outputs are AI-generated and can be inaccurate.

Do not rely on outputs for medical, legal, financial, or safety-critical decisions.
Do not use Kindpair in emergencies or high-risk situations.
If you publish outputs, verify facts and label AI-generated content when required.

Suspension and Termination

Access may be suspended or terminated for policy, security, billing, or legal reasons.

You can stop using Kindpair at any time.
Some records may remain in backups or where required by law.
Ownership, disclaimer, liability, and dispute sections survive termination.

Disclaimers and Liability Limits

KINDPAIR IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINDPAIR DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINDPAIR IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA OR PROFITS. TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM (OR USD $100 IF NONE).

Governing Law and Venue

These terms are governed by California law (excluding conflict-of-law rules). Disputes are handled in state or federal courts located in San Francisco County, California, unless applicable law requires otherwise.
